1. Acceptance of These Terms

By accessing or using The Recruiter at the-recruiter.org ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Platform.

These terms apply to all users of the Platform, including candidates who register profiles, visitors who browse the job board, and any recruitment companies or employers who access candidate data through our services.

2. What The Recruiter Does

The Recruiter is a recruitment platform with two main functions:

• Candidate profiles - Candidates can register a profile that becomes discoverable by multiple recruitment companies. Your profile acts as a standing expression of interest in new opportunities.
• Job board - Employers and recruiters can post vacancies that candidates and visitors can browse and apply for.

We act as a connector between candidates and recruitment companies. We are not an employer, staffing agency, or party to any employment agreement that may result from introductions made through the Platform.

3. Creating an Account

To register a candidate profile or post jobs, you must create an account. When you do:

• You must provide accurate, current, and complete information.
• You are responsible for keeping your login credentials secure.
• You must notify us immediately if you suspect unauthorised access to your account.
• You must be at least 16 years old to use the Platform.

We reserve the right to suspend or delete accounts that contain false information or that violate these terms.

4. Candidate Profiles and Data

When you register as a candidate, your profile - including your name, work history, skills, and any other details you provide - may be made visible to recruitment companies that use the Platform. By registering, you explicitly consent to this.

You are in control of what you share. Please only include information you are comfortable sharing with prospective employers and recruiters. Do not include sensitive personal information beyond what is relevant to your professional profile.

You can request to update or delete your profile at any time by contacting us at hello@the-recruiter.org. We will action your request within a reasonable timeframe.

5. Candidate Responsibilities

If you register a candidate profile, you agree that:

• All information in your profile is truthful and accurate to the best of your knowledge.
• You will not misrepresent your qualifications, experience, or credentials.
• You will keep your profile reasonably up to date.
• You will not register multiple profiles for the same person.
• You will not use the Platform to harass, spam, or mislead recruiters or employers.

6. Job Listings

Job listings on the Platform are posted by third-party employers and recruitment companies. We do not verify the accuracy or legitimacy of every listing. We make reasonable efforts to remove fraudulent or misleading postings when they are reported to us, but we cannot guarantee that every listing is genuine.

If you spot a suspicious job listing, please report it to us at hello@the-recruiter.org and we will investigate promptly.

The Recruiter is not responsible for the outcome of any application you make, or for any offer, contract, or employment relationship that results from a listing on the Platform.

7. Employer and Recruiter Responsibilities

If you post jobs or access candidate profiles through the Platform, you agree that:

• All job listings are for genuine, lawful employment opportunities.
• You will not post misleading salary information, false job titles, or fabricated roles.
• You will handle candidate data in accordance with applicable data protection laws, including GDPR where applicable.
• You will only contact candidates for legitimate recruitment purposes.
• You will not share or sell candidate data to third parties without explicit consent.
• You will not use the Platform to conduct mass unsolicited marketing campaigns.

Violation of these responsibilities may result in immediate account termination and, where appropriate, referral to relevant authorities.

8. Acceptable Use

You must not use the Platform to:

• Post or transmit any content that is unlawful, fraudulent, defamatory, or discriminatory.
• Scrape, harvest, or collect data from the Platform by automated means without our written permission.
• Attempt to gain unauthorised access to any part of the Platform or its underlying systems.
• Interfere with the normal functioning of the Platform or its servers.
• Impersonate another person, company, or organisation.
• Upload viruses, malicious code, or any content designed to harm users or systems.

9. Intellectual Property

All content on the Platform - including the design, logo, text, graphics, and software - is owned by or licensed to The Recruiter and is protected by copyright and other intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written permission.

Content you submit to the Platform - such as your candidate profile or job listings - remains yours. However, by submitting it, you grant us a non-exclusive, royalty-free licence to store, display, and distribute that content as necessary to operate the Platform.

10. Disclaimers

The Platform is provided on an "as is" and "as available" basis. We do not guarantee that the Platform will be uninterrupted, error-free, or free from security vulnerabilities.

We do not endorse any employer, recruiter, candidate, or job listing. Any interaction you have with a third party through the Platform is at your own risk.

We make no warranties - express or implied - about the accuracy or completeness of any content on the Platform, including job descriptions, salary ranges, or candidate profile information.

11. Limitation of Liability

To the fullest extent permitted by law, The Recruiter will not be liable for any indirect, incidental, special, or consequential losses arising from your use of the Platform. This includes, but is not limited to, loss of income, loss of business, loss of data, or any harm resulting from a job application, hiring decision, or employment relationship.

Our total liability to you for any claim arising from these terms or your use of the Platform will not exceed the amount you paid us (if anything) in the 12 months preceding the claim.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

12. Third-Party Links and Services

The Platform may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or reliability of any third-party sites. Visiting those links is at your own discretion.

13. Termination

You can close your account at any time by contacting us at hello@the-recruiter.org.

We reserve the right to suspend or terminate your account, with or without notice, if we believe you have violated these terms or if continued access poses a risk to other users or to the Platform. In serious cases - such as fraud or data misuse - we may also take legal action.

Upon termination, your right to use the Platform ceases immediately. We will handle any personal data in your account in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms and Conditions from time to time. When we do, we will update the "Last updated" date at the top of this page. For significant changes, we will notify registered users by email.

Continuing to use the Platform after changes are posted means you accept the updated terms. If you do not agree to the revised terms, you should stop using the Platform and close your account.

15. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the Platform will be subject to the exclusive jurisdiction of the relevant courts.
